The introduction of restrictions on holding public office for people who worked for repressive bodies of the totalitarian regimes and held leading positions in the Bulgarian Communist Party and a new election of the Prosecutor General, the Supreme Judicial Council and the Prosecutorial Council are proposed by Democratic Bulgaria MPs. amendment of the Constitution.
The entire leadership of the judiciary and the prosecution should be elected under the new rules six months after the texts are adopted. The proposals for changes in the Constitution are written on 5 pages and affect 15 articles, as some of them are changed, others are repealed, and others are added (see the changes in the attached file).
Among the proposals is to reduce the term of the prosecutor general from 7 to 5 years, with him being elected by parliament instead of the SJC.
The DB also wants the SJC to consist of 15 instead of 24, with a parliamentary quota of five members, with 11 now. 8 of the members should be elected directly by the judges.
Another novelty is that the final decision on the dismissal of the chairmen of the SAC and the SCC should be made by the Constitutional Court, as a form of prevention against politically motivated changes.
It is also envisaged that all courts and every citizen may file a complaint with the Constitutional Court.
The explanatory memorandum states that if the new texts are adopted, there will be an independent court and a responsible prosecutor’s office, as well as a radical judicial reform. In addition, the independence of judges is being strengthened.
