Ancelmo Gois’ blog was the first to report on the process. The Cruz-Maltino legal department invokes the right of preference for renewal described in article 11 of the Pelé Law, which says the following:

“If the training sports practice entity offers the same conditions, and, even so, the athlete opposes the renewal of the first special sports work contract, it may demand from the new contracting sports practice entity the compensation amount corresponding to, at most , 200 (two hundred) times the value of the monthly salary stated in the proposal”.

In the renewal proposal rejected by Pimentel in May, Vasco offered an initial salary of R$20,000 per month – the compensation, therefore, could reach R$4 million. There is also a request for Porto to be ordered to pay 200x the salary offered to the player, the value of which has not been revealed. The case was distributed to the 43rd Civil Court of the Capital District.

In the opening piece, Vasco cites a recent decision by the FIFA court on the case. In August, FIFA allowed Pimentel’s transfer to Porto and ordered Vasco to release the player’s documents, but on the other hand it did not go into the merits of the compensation and said that this must be claimed by local judging bodies.

For this reason, Vasco approached the Rio Court of Justice.

In a certain part of its argument, Vasco refers to Porto as a “second-rate European club”.

“The aforementioned scenario can be explained by a trend that is reflected in the facts narrated in the present demand: second-rate European clubs, such as the defendant FC Porto, come to the Brazilian club to attract young players, trained by Brazilian clubs, taking them for free or for ridiculous prices, with the promise of offering them access to Old World football. After a while, these clubs resell the sporting links of these players to first-class European clubs, at much higher prices – consistent with market standards -, carrying out profitable operations”said Vasco.
