The Fate of Employees if Omnibus Law Creates Work Verified … Page all

KOMPAS.com – Legal Plan (Bill) all Law Create Work is just one step away from becoming a law.

The government together with the DPR have approved the bill to be brought to the Plenary Meeting on October 8 2020.

Reported Kompas.com, Sunday (4/10/2020), the agreement took place at the DPR Legislation Body (Baleg) Working Meeting with the government and DPD on Saturday (3/10/2020) night.

Padahal, RUU all Law This has generated a number of polemics in the community, especially regarding the labor cluster.

According to him, the issue of worker status is one of the triggers for the drafting of the Omnibus Law.

Because, he said, so far in Law Number 13 of 2003 concerning Manpower, companies have a responsibility to provide severance pay to workers who are fired or laid off.

“An Omnibus Law has emerged, so that investors will enter and not be disturbed by laborer, “said Agus when contacted Kompas.com, Sunday (4/10/2020).

“So make it the article, that there is no validity period of the contract. It is opposed by workers, meaning that workers do not have a guarantee of losing their job,” he added.

And menilai All Law ruu Cipta Kerja has positive and negative sides.

The positive thing is for the company, it can get investors and can hire foreign workers more easily.

“Instead of making a fuss (with workers), it is better for the company to take foreign workers. When it is finished one day, go home, replace it again,” he said.

Meanwhile, the negative side is borne by workers, because they do not have guarantees if they lose their jobs.

Decreased protection

Contacted separately, Secretary General of the All Indonesia Workers Organization (OPSI) Timboel Siregar added, if the Omnibus Law on Job Creation was passed into law, it would clearly be very detrimental to workers.

He said that protection for workers would decrease.

Timboel is worried that the company will open the contract system as widely as possible outsourcing. This option, according to him, will cause certainty for workers to be lost.

“The constitutional right to get a decent job will be degraded by this Job Creation Law,” Timboel told Kompas.com, Sunday (4/10/2020).

In addition, Timboel considered, there were a number of things that were burdensome for workers. Namely, the rules related to work agreements for a certain period of time (PWKT), minimum wages, layoff process and compensation, and job loss benefits (JKP) are submitted to the Government Regulation (PP), not laws.

According to him, the issue related to workers’ rights should be the DPR, which is the people’s representatives, to ensure it, not just leave it to the government.

“I think that norms related to constitutional rights should be regulated in laws, not in PP,” said Timboel.
