No one can take this seriously.
This is probably a bit of self-regulation. The legislator says to a sector: “If you don’t solve this problem, we will regularize it!” The sector responds to this by setting up a committee that is little more than a paper tiger, so that they can say: “We have done something about it. Look, a website with all the offenders!”.
I remember that we had to wait years for deposits on cans and plastic bottles. The branch claimed it would solve it itself, and the government believed that for years. Or believe it…, a liberal government is of course not interested in regulating the market; rather than misleading advertising and a roadside full of Red Bull cans; much better for the economy.
Just for fun, look who’s in the Commission to sit:
- a member of the BVA (Association of Advertisers)
- a member of the Consumers’ Association
- a member of the media participating in the Advertising Code Foundation
- a member of the VCA (association of communications consultancy firms)
- a chairman, appointed by the Advertising Code Foundation
I only have any confidence in a member of the consumer association.

Don’t take my sour reaction at the end of the day too seriously, what @citomaster writes sounds much more authoritative.
Practice also shows that almost all advertisers adjust or withdraw their advertising in the event of a negative decision.
