MADRID, 2 Feb. (EUROPA PRESS) –
The European Court of Human Rights has summoned Turkey to appear to explain the early dismissal of 169 judges in 2016 and the violation of the right to a fair trial and the right of access to a court.
The court has explained through a statement that Turkey was informed of the summons last week, when the Turkish Government was informed that it should be in a position to respond before mid-May to questions such as whether the people affected by these dismissals had access to a court.
The investigation focuses on two specific moments, one of them to the dismissal of 49 judges from the Council of Judges and Prosecutors in 2014 after the entry into force of a new law. According to the information provided by the statement, on May 14, 2014, the Constitutional Court ruled this provision unconstitutional and annulled it.
The other in 2016, when another law shortened the mandates of 120 judges of the Supreme Administrative Court, as well as the Court of Cassation.
In both sets of cases, the plaintiffs were appointed as judges in other cases, thus questioning access to a fair trial and the right of access to a court.
