The Dutch Consumer and Markets Authority confirms no significant market power in the retail market for fixed internet and business network services

The Dutch Consumer and Markets Authority maintains its conclusion that there is no ‘significant market power’ in the retail market for fixed internet and business network services. The decision will now be sent to the European Commission, after which it can be made final.

The ACM has published its ‘draft decision on local access market analysis’ presented to the European Commissionwho has to make a decision. The EU has one month to respond to the decision. After approval from the EU, ACM can make the decision final.

The ACM already submitted its provisional decision to parties in the internet market for consultation on July 8. “The views and the subsequent investigation did not give rise to substantial adjustments to the consulted draft decision,” the market regulator now writes.

The ACM shared its provisional decision in July. The regulator concluded that there is no significant market power in the fixed internet market. The reason was an investigation into the fixed internet market, which was initiated after the Appeals Board overturned an earlier decision that VodafoneZiggo had to open its cable network to competitors. In the new study, the ACM looked at the competition surrounding ‘fast internet’ in various markets.

After the investigation, the regulator stated that the rapid rollout of fiber optic networks that are available to different providers leads to sufficient competition. No additional measures are therefore needed to stimulate competition. This means, among other things, that Ziggo does not have to open its coax network to competitors again. KPN, which has previously made binding price agreements together with Glaspoort, does not have to adjust the existing conditions for access to its networks.
