The curfew is coming – but many cities and counties think it is wrong – Southwest

The corona hotspots in the country are receiving new measures in the fight against the pandemic. However, many cities and districts have doubts about the sense of curfew for restaurants after 11 p.m.

The Baden-Wrttemberg County Council and representatives of South Baden cities and districts doubt the usefulness of curfew in the fight against the corona pandemic. The state government had ruled that restaurants in regions with many new infections must close at 11 p.m. In addition, the serving of alcohol is restricted.

Is the regulation unconstitutional?

The President of the District Assembly, Joachim Walter, has registered legal concerns about this requirement in Corona hotspots with the Ministry of Social Affairs. That said the managing director of the district council, Alexis von Komorowski, the BZ. “Quite a few counties” are disproportionate encroachments on the freedom of occupation. Therefore “such a blanket curfew regulation would be unconstitutional”.

Minister of Social Affairs Manfred Lucha (Green) announced that he would send the health departments another clarifying decree on curfew. The decree that the ministry sent to the health department on October 16 was clear. “So it remains the same: With a 7-day incidence over 50, a blocking period from 11 p.m. must be introduced,” said a spokesman.

Freiburg’s Lord Mayor Martin Horn (independent) said the curfew would be implemented in the city from Thursday. However, he was skeptical: “Personally, I am not 100 percent convinced of the curfew. We just saw in Berlin that it was overturned by the court.” There is also too little capacity in the prison service and the police to adequately control the curfew.

Kai Hockenjos, spokesman for the Ortenau District Office, said at curfew: “We doubt the usefulness.” It is to be expected that guests will use the time until curfew more intensively and then retreat to the private setting to celebrate, “where things may get even tighter”. The landlady for the district of Breisgau-Hochschwarzwald, Dorothea Strr-Ritter, however, said: “curfew and alcohol bans are now important in order to further reduce the contact possibilities of people and thus lower the risk of infection.”

Meanwhile, the state of Baden-Wrttemberg as a whole has exceeded the critical value of 50 new infections per 100,000 inhabitants within seven days. According to the State Health Office, the value is 53.4. Freiburg, the Breisgau-Hochschwarzwald district, the Ortenau district and now again the Emmendingen district are located in Sdbaden.
