(ANSA) – ROME, NOV 21 – The Government’s plan to entrust to the Courts of Appeal, in a monocratic composition, the competence of the “procedures” for “validation” of the “detention” or “extension of detention” of the migrant requesting “international protection”. On Wednesday the green light arrived from the Constitutional Affairs commission of the Chamber for the rapporteur’s amendment to the Flussi decree. Procedures, therefore, which would no longer be the responsibility of the specialized Immigration section of the Court, which instead remains competent for disputes “concerning the challenge of measures” due to the “failure to recognize the conditions for special protection”. The majority’s initiative has already received harsh criticism from the ANM which complains about the risks of a heavy increase in work so much so that, according to the robes’ union, the Courts could have to face “the occurrence of 30,000 proceedings per year, from however, define in a very short timeframe”. Concerns also shared by the presidents of the Courts of Appeal who in recent days sent a letter to the President of the Republic, Sergio Mattarella, in which they speak of an “announced disaster”. For Italian criminal lawyers, the transfer of jurisdiction “leaves on the table the not insignificant question of the organization of offices which are burdened by a mass of proceedings such as to affect their overall efficiency”.
