She stated that the plaintiff and the defendant should agree on a specific start date of the trial with the court.
Musk’s lawyers had requested that the case be heard in February, but the court ruled in favor of “Twitter”, which wants the hearing to begin earlier. “Twitter” lawyers had asked to start considering the case already in September.
In its complaint, Twitter is asking the court to order Musk to complete its $44 billion acquisition, stressing that no amount of financial compensation can repair the damage he has done to the company.
Musk announced on July 8 that he was backing out of the deal to buy Twitter, and accused Twitter of making misleading statements about the number of fake accounts on the platform. Musk signed the purchase agreement for 44 billion dollars in April.
On the other hand, the lawyers of “Twitter” have said that Musk’s arguments are just an excuse to refuse the deal.
Twitter insists that the proportion of fake accounts on the platform is less than 5%, but Musk claims that it is much higher and that the company does not allow to find out the true number of fake accounts.
Musk said in May that the deal to buy Twitter would not go ahead if he did not receive evidence of the proportion of fake accounts on the platform.
The concluded contract for the purchase of “Twitter” provides compensation in the amount of one billion dollars for its termination.
