The Dijon Court of Appeal issued a judgment on Tuesday, June 29, ordering the expulsion “without delay” of the occupants of the Jardins de l’Engrenage house. A set of buildings must be built on the site. The initial decision called for their departure for September.

Justice ruled on Tuesday, June 29 for the expulsion “without delay” occupants of the Maison des Jardins de l’Engrenage, located in Dijon (Côte-d’Or), avenue de Langres near the Nation tram stop. A housing complex of several buildings must be built on this site. The land had already been evacuated last April, but the occupants of the house had until September 2021 to vacate the premises.

“A decision without surprise”

The Dijon Court of Appeal, seized by the Dijon town hall, decided to contradict the decision of the first judge and ordered an expulsion “without delay” occupants in a judgment rendered at the end of the day on Tuesday, June 29, 2021. “It’s an unsurprising decision because the appeals court has a pretty strict stance on occupations without rights or titles. I wasn’t really expecting anything else.”, told us the lawyer for the occupants of the premises, Maître Dominique Clémang.
