The claim of SP-2 will be considered again in the European court

The appeal of the Nord Stream 2 operator was returned for consideration to the court of general jurisdiction of the European Union.

The court of the European Union recognized the claim of the Nord Stream 2 operator Nord Stream 2 AG regarding the EU gas directive as “partially admissible”. As a result, the court overturned the previous decision that had dismissed the claim. The relevant court decision was published on Tuesday 12 July.

As follows from the document, the appeal was returned for consideration to the court of general jurisdiction of the EU.

“Nord Stream 2 AG is specifically concerned about the terms of exclusion or derogation, modified or included in the amending directive, as a result of which its claim for annulment should be recognized as justified within this separate concern,” the court said in the decision.

Remember, in Germany stopped certification of Nord Stream-2 even before the start of the Russian invasion of Ukraine, and after the start of the war in the United States, they said that SP-2 is now “dead”.


The directive entered into force in 2019. The document extends the rules of the domestic natural gas market to pipelines of third countries. Thus, the document extended the norms of the EU’s Third Energy Package to gas pipelines that come from other countries. In 2020, the court rejected the Nord Stream operator’s claim to challenge the directive. In 2021, the company tried to get an exemption from the directive in Germany, but lost the court.
