The court canceled the regional status of the Russian language in the Dnipropetrovsk region

The court decided to fully satisfy the petition of the regional prosecutor’s office and to declare illegal the decision of the Dnipropetrovsk regional council to support the language policy in Ukraine, according to which the regional status of the Russian language was preserved.

The court also recognized that this decision of the regional council contradicts the current law on the state language.

The decision will enter into force after the deadline for filing an appeal by all participants in the case expires.

By data Commissioner for the protection of the state language Taras Kremen, in mid-July, in addition to the Dnipropetrovsk region, the decisions of local councils on the functioning of regional languages ​​in the Luhansk region, as well as in individual communities of the Odessa and Transcarpathian regions, remained in force.

Context:

In 2012, Ukraine adopted a law “On the Foundations of State Language Policy” (known as the Kolesnichenko-Kivalov Law), which significantly expanded the use of non-state languages ​​in the country.

During the period of the law, the status of a regional Russian language received, according to “Observer”, in a number of regions – Kherson, Donetsk, Zaporozhye, Lugansk, Kharkov, Nikolaev, Odessa, as well as in Sevastopol and the Autonomous Republic of Crimea.

In some settlements of the Odessa and Chernivtsi regions, the status of the regional was also assigned to the Bulgarian, Gagauz, Moldavian and Romanian languages.

February 23, 2014 Verkhovna Rada canceled Kolesnichenko-Kivalov law, and in 2018 the Constitutional Court of Ukraine ruled that the adoption of this law did not comply with the procedure for considering draft laws by the Verkhovna Rada.

Since February 2014, local governments began to cancel decisions on the status of the Russian language as a regional language. So, on October 20, 2014, it was canceled by the Kherson City Council, the newspaper reported “Kherson News”, in November 2018 – Kharkiv regional council.

The City Council of Nikolaev on May 20, 2021 considered this issue, but could not reverse my decision… Eventually it was canceled by the court – as in Odessa region, Zaporizhzhia, Zaporizhzhya region, Nikolaev region.
