In Ukraine, once again blocking sites through the courts

Due to the lawsuit of the former head of Spetstechnoexport Pavel Barbul, the court blocked access to 12 publications.

By the decision of the Pechersk District Court of Kiev in Ukraine, 12 Internet publications were blocked, writes Commander-in-Chief, which also ended up on this list.

“Judge of the Pechersk District Court, Tatyana Ilyeva, decided to seize the intellectual property rights of a number of information publications: in particular, the Chief Commander, Apostrophe and other media outlets,” the statement says.

On February 18, a judge of the Pechersky Court seized the intellectual property rights of the domain names of 12 publications due to the claim of the former head of Spetstechnoexport Pavel Barbul.

The court ordered all Internet providers and mobile operators on the territory of Ukraine to block their work.

It is noted that the police consider Barbula’s claims groundless and decided to close the criminal case due to the absence of a criminal offense.

Despite this, on March 24, some mobile operators, as well as Internet providers, blocked access to 12 publications.

Blocked publications intend to defend their rights in court.

Note that the blocking scheme was first tested in the case of the Korrespondent.net website, when the court ruled to block the site because of an article in the blogs section, for which the editorial board is not responsible.

On July 23, 2019, the controversial judge Serhiy Vovk issued a ruling, which ordered Ukrainian Internet providers and mobile operators block 18 web resources, among which there was a section of blogs Correspondent.net.

In Vovk’s decision, the blocking of sites was called “the seizure of intellectual property rights that arise from Internet users when using these websites, by the obligation of Internet providers to close access to them.”

Thus, through the courts, they tried to block information – an investigation of public activists.

The decision obliging providers to block information sites, including blogs.korrespondent.net, contradicted the current legislation of Ukraine and international standards in the field of protecting freedom of speech, lawyers of the Digital Security Laboratory noted.

In June 2020 Pechersky the court overturned the decision to block sites.
