The European Court of Justice ruled last year that such an agreement is acceptable if the aim is to ensure security in port areas. According to the Court, the fact that port workers can only be recognized by a mixed committee of employers and workers was contrary to EU law.
The Council of State has now ruled that the Belgian regime does not resist the union with the ruling of the European Court. Among other things, the composition of the recognition committees is a problem due to “insufficient guarantees of impartiality”.
