I came to the conclusion that the rights under the old fortress deed should be recreated, and it is in favor of the embassy, says the lawyer who signed the notary deed for the temple in 1997.
I accept the case only as political, and I have nothing to do with politics, neither with political forces nor with foreign countries. I am Bulgarian and I take the work I do as responsible enough to put all my efforts into it.
This was commented to “24 Chasa” by notary Ivan Dakhterov, who in 1997 signed the ascertaining notarial deed for the ownership of the church “St. Nikolay Myrlikiski”.
After the expulsion of Archimandrite Vasian Zmeev and the other two officials in the Russian Church, it was locked. Protests followed, sharp political reactions and a dispute over whose temple it was and who had the right to serve in it.
On Wednesday, the deputies Delyan Peevski, Boyko Borisov, Kiril Petkov and Ivaylo Mirchev sent a signal to the chief prosecutor to check if there is a crime in the case.
“We filed a report with the prosecutor’s office about the property of the Russian Church. In our opinion, it is not even the Russian state. It is reported to the Russian Embassy, legal succession from Tsarist Russia. To us, this sounds absurd, but only the prosecutor’s office can decide. The file lacks ownership documents. In our opinion, there is a crime by the notary, issuing this deed. I hope that the prosecutor’s office will request the annulment of this notarial deed in order to return the property to the Bulgarian church”, said Delyan Peevski at the time. The Fort Act of 1898
I always conscientiously fulfill my obligations under the law. That was the case in this case as well, notary public Ivan Dakhterov commented in response.
After the report to the prosecutor’s office, they announced that they are starting an inspection of the property, but they cannot interfere in canon law and in who can serve in the Russian Church.
Notary Dakhterov had not been contacted by the prosecutor’s office and DANS until Friday noon
According to him, they need time to gather information and then invite him to give explanations.
I have no doubt that I will be called because it requires their work. However, I don’t know what the mood will be and whether they will show rudeness, which will make the issue even more political, because there is no legal problem in the case, Ivan Dakhterov is categorical.

Then there are no private ones. In Sofia, they work in the building on “Patriarch Evtimiy” Blvd. and “Graf Ignatiev” Street.
Meetings with lawyers and participants in notarial proceedings took place on a random basis by presenting documents at the “Registry” desk. This case study was one of many that were considered by me as a “public” notary public. The only thing I remember is that then the question arose whether the embassy or the Russian state owned the rights. I came to the conclusion that the rights should be recreated as they are according to the old serf act, and it is in favor of the embassy, says notary Dakhterov. At that time, working conditions required spending about half an hour on each case. That was the official schedule. There was no way to add documents presented to the notary in that half hour. In reality, the main ones are always described, so I cannot know if other documents such as building permits and architectural projects were not presented then. However, this is of no legal significance, because in principle, whoever owns the land also owns what is built on it. A notorious fact is the existence of the Russian Church in the center of the city of Sofia, adds the lawyer on the case. The notary did not comment on the church’s problem with disputes over who can serve in the closed temple. His information is that since both churches – the Russian and the Bulgarian – are Eastern Orthodox, there cannot be representations of one at the other, as is the case at the embassies.
Eastern Orthodox worship in Bulgaria can only be under the “cap” and management of the Bulgarian Patriarchate. This does not apply to any confession other than the Orthodox, says Ivan Dakhterov.
After the scandal with the property of the Russian Church, the serf act of 1898 was discovered in the State Archives.
According to Prof. Rumyana Mikhneva, many documents were attached to the issuance of the serf deed, which are available in Bulgarian and Russian archives. She applied them in her book “On the Roads of Diplomacy. Events, People. Places of Memory 1879-2019”.
These are a site plan from 1879 designated for the Russian mission in Sofia, minutes of the meeting of the municipal council, which provided the plot of land for a building of the Russian diplomatic agency, a letter from the Russian diplomatic agent Davydov to designate a plot of land for the construction of building of the Russian Diplomatic Agency, a letter from the Ministry of the Interior to the Consul General of Russia from 1882 and a letter to the Russian diplomatic agent from the Sofia Municipal Council.
