The Controversial Case of Yonsei University Cleaning Workers and Students: A Legal Re-Examination by the Seoul Metropolitan Police Agency

As you probably remember, last year, there was an incident in which some students sued cleaning workers who held a rally demanding improvement in Yonsei University, saying that they were disruptive to class because they were noisy.

After the investigation, the police station in charge decided last month to end the case without handing it over to the prosecution, saying there was no guilt, but the Seoul Metropolitan Police Agency suddenly announced that it would reconsider.

It’s been over until the party has been notified, which is very unusual.

In March last year, Yonsei University cleaning workers protested on campus.

It was a demand at the level of basic rights, such as an hourly wage increase of 440 won according to the extent of the increase in the minimum wage and the installation of shower rooms.

However, three students from this school sued them for obstruction of business and violation of the Assembly and Demonstration Act, saying, “The right to study was violated because of the noise at the assembly.”

The police, who launched an investigation, decided not to ask for charges of obstruction of business in December of last year.

It’s not loud enough to disturb class.

All that remains is the charge of violating the Assembly and Demonstration Act due to the ‘unreported assembly’.

The police concluded on the 9th of last month not to hand this over to the prosecution.

The reason was that ″It was a legitimate industrial action that took place in the workplace for about 40 minutes during lunch break.″

However, after just three weeks, the police reversed their conclusions themselves.

The Investigation and Deliberation Division of the Seoul Metropolitan Police Agency started a legal review, saying that they would reconsider the decision to not send the case for the charge of violating the Assembly and Demonstration Act.

It is very unusual for the police to re-examine a case that has not been notified to the party.

″I don’t understand why everyone is trying to overturn it (they say they are innocent). It really upsets me.”

The police explained that ″an internal point has been made that it may be a violation of the law if there is no prior notification, and we are looking at existing precedents.″

″Never in 16 years (never made it an issue). The prime minister (Yonsei University) didn’t say anything about coming out during the dispute.”

Apart from criminal charges, Yonsei University students charged 6.38 million won to cleaning workers, and the court battle began yesterday.
