The content of Cadre’s lawsuit to the West Jakarta District Court against Golkar National Conference, Serang Bahlil

The results of the XIth National Conference (Munas) of the Golkar Party which also confirmed Bahlil Lahadalia as General Chairman (Ketum) prosecuted at the West Jakarta District Court (PN Jakbar).

One of the lawsuits was made by the head of Golkar Party in M. Rafik. He explained that the lawsuit was filed because the implementation of the National Conference violated the Golkar Articles of Association and Bylaws (AD/ART).

The reason, he said, based on Article 39 Paragraph 2 point 2 of Golkar 2019 AD/ART, was that it was said that the National Conference should only be held in December 2024 and not in August last year

Therefore, he questioned Agus Gumiwang’s leadership measures in establishing a National Conference forum immediately on August 20-21 and issuing a Committee Order on August 15, 2024.

“That is why one of our objections to the PN is asking for a PN that’s all “Cancelling all the results of the unconstitutional XI National Conference on August 20-21, 2024 in Jakarta because the legal basis for its implementation was wrong,” he explained.

On the other hand, Rafik also hopes that the Ministry of Law and Human Rights can cancel the results of the XI National Conference of the Golkar Party, including the elimination of Bahlil as the Chairman of Golkar.

“At this time, the Indonesian Ministry of Law and Human Rights, cq the Director General of the General Legal Administration (AHU), will not immediately receive the official report on changes to the Golkar Party Legal Group for the period 2019-2024 because this. a case is being submitted to the District Court,” he said.

Rafik also explained that this lawsuit was filed at the West Jakarta District Court with Case number 762/Pdt.Su-Parpol/2024/PN Jkt.Brt dated 08/23/2024.

At the same time, the General Deputy Chairman of the Golkar Party, Adies Kadir, said that the Golkar Party was ready to face the lawsuit against the results of the National Conference submitted to the court.

“Please allow people to sue, everyone has the right to sue, we will only deal with it according to AD/ART rules as well as legal and constitutional provisions,” said Adies, Saturday (24/8).

Adies believes that no rules in the AD/ART were violated in organizing the Golkar National Conference.

He said that all AD/ART change process regarding date, month and year of Golkar National Conference was confirmed and confirmed from Plenary Meeting of Golkar Party DPP and Rapimnas.

“The Voting Rights Holders of Regional DPD and Regency/City DPD and Constituent and Constituent Organizations, 561 votes in total requested that the National Conference be expedited so that it could be held in August 2024,” he continued.
