The Consequences of Installing Fake Traffic Signs in Baden-Württemberg

Fake traffic signs were recently installed in Baden-Württemberg. Those responsible can sometimes face penalties.

In front of many educational institutions such as kindergartens and schools there are signs that indicate a recommended speed limit. In Baden-Württemberg, more and more fake traffic signs were put up. According to the road traffic regulations, however, this is not permitted. Drivers do not have to follow signs posted by private individuals.

In the meantime, they have already asked some parents whether it is even legally permissible to put up a traffic sign in front of a school. This does not appear to be punishable, provided the wrong traffic sign does not obstruct traffic or distract drivers from traffic. For example, the new sign must not flash or shine. In addition, following these signs is entirely voluntary.

Road users are therefore not forced to comply with the rules required on the sign. However, this only works if drivers really recognize that these are unofficial traffic signs. However, many of them look deceptively real. As a result, some motorists cannot even tell that the sign is wrong when driving past.

Criminal and arrogance: imprisonment for up to two years

However, it is a criminal offense to put up deceptively real signs. The difference must be clearly visible. Otherwise there is a fine of 15 euros. If there is a serious case of assumption of office, it can even result in a prison sentence of up to two years. This also affects the dummy speed cameras that one or the other has in the front yard. Such false speed cameras as well as traffic signs that look deceptively real are prohibited in Baden-Württemberg and in the entire Federal Republic of Germany.

Anyone who believes that there should be a speed limit on their own street should contact the municipality and describe the case. There is even a template for an application on the German Environmental Aid website. There you can also order the false traffic signs that ask drivers to voluntarily drive 30 km/h. However, these signs must never cover other traffic signs or impede traffic.
