The Burgas court remanded a thief who attacked and robbed a Norwegian in Sunny Beach – 2024-09-10 07:52:09

The Burgas Court of Appeal upheld a ruling that dismissed Hilmi M.’s request to change the remand measure from “detention in custody” to a lighter one.

Hilmi M. has been brought in as an accused for having taken foreign movable property in the “Sunny Beach” complex, near the “Mystic” bar – a mobile phone, a mobile phone case, a wallet and the sum of BGN 700, all with a total value BGN 3355.98, from the Norwegian citizen JB

The accused used force for this – he hit the victim in the left shoulder with a hard object, followed by a fall and loss of consciousness, and the robbery was accompanied by causing moderate bodily harm – a fracture of the left collarbone – a crime under Art. 199, para. 1, item 3, sentence, Art. 198, para. 1 NC.

The charge is a “serious” crime, as it carries a sentence of imprisonment of five to fifteen years.

The second instance considered that the defendant’s appeal against the district court’s refusal to modify his permanent arrest was unfounded.

The well-founded assumption of Hilmi M.’s complicity in the crime has not been dropped. In support of the accusation are the conclusions of the prepared technical and video-technical expertise, the testimony of witnesses and the established DNA traces.

There is still a real danger of the accused committing a crime.

This conclusion is justified by the data from his criminal record, establishing the presence of previous criminal activity, as well as based on the manifested features of the investigated criminal act. The term of detention of the person does not exceed the legal limit and is within the reasonable limits, the appellate judges indicate.

The judgment issued by the Appellate Court ¬ Burgas is final.
