The Balearic courts resolve 3,174 mortgage floor clause issues in 2020 and reach a 190.5% resolution

This is collected by the data published this Monday by the General Council of the Judicial Power (CGPJ), which indicates that these courts entered 1,666 cases during 2020 in the Balearic Islands.

The matters that enter the courts not only conclude when a sentence is passed; They can also end by final order or decree when, for example, several lawsuits referring to different clauses of the same mortgage are accumulated in a single procedure or the resignation or withdrawal of one of the parties occurs.

In a year marked by the pandemic, the region scores its highest resolution rate in 2020 since the launch of these Courts in 2017.

Since the creation of these Courts, 13,375 cases have been filed and 9,641 resolved in the Balearic Islands. In total, 7,697 judgments have been handed down in this regard in the Community and the resolution rate stands at 72.1%, higher than the average for the Autonomous Communities.

Only in the fourth quarter in the Balearic Islands, 595 land clause issues were entered and 1,081 were resolved, with a resolution rate of 181.7%. 993 sentences were handed down between October and December. THE SOIL CLAUSES COURTS IN SPAIN

The CGPJ affirms that the levels of pendency of the courts of abusive clauses maintained the downward trend in 2020 despite the paralysis of judicial activity due to Covid-19.

The number of pending cases in the Spanish courts specialized in floor clauses stood at 239,445 at the end of the year, which represents a decrease of 1.88% compared to 2019, when pending cases totaled 244,036.

In this sense, the CGPJ highlights that the reversal occurred especially during the second and third quarters of the year, having entered up to 110,426 new cases in the year, that is, 22,045 less (-16.64%) than those registered in 2019 .

Since its launch, on June 1, 2017, these judicial bodies have received 583,964 cases and have resolved 358,512, which is equivalent to 6 out of 10 cases, 61.39%.

RESOLUTION RATE ABOVE 100%

The annual resolution rate at the national level in 2020 remained above 100%, standing at 104.1%, just 2.8 points less than the rate registered in 2019 (106.9%).

The resolution rate is the quotient between the cases resolved and those admitted in a certain period and relates the volume of income with the resolution capacity of the courts.

In this way, the overall resolution rate since the launching of the courts specialized in abusive clauses in mid-2017 has experienced a year-on-year improvement of 16.8 percentage points, despite the 50% registered as of December 31, 2019 at 66.8% at the end of 2020.

ARAGON AND EXTREMADURA, AT THE HEAD

By Autonomous Communities, Aragon (340.6%), Extremadura (234.1%), Balearic Islands (190.5%), Canary Islands (187%), Navarra (177.6%) were above the national average in 2020 ), Catalonia (174.1%), Andalusia (148.6%), Castilla-La Mancha (147.3%), Basque Country (144.7%), La Rioja (137.7%), Murcia (125 %) and Galicia (121.5%).

Behind are the Valencian Community, with a resolution rate of 121%; Asturias, with a 112.3%; and Castilla y León, with 111%. The lowest and, below the average, are found only in Madrid (28.04%) and in Cantabria (96.9%).

On the other hand, the floor clause courts handed down a total of 97,450 sentences in the year 2020, raising to 296,212 the rulings since the start-up of these specialized bodies, on June 1, 2017.

97.9% percent of those issued in the analyzed year were favorable to the client, up to a total of 95,449 sentences. Likewise, 9,788 final orders and 6,798 decrees were issued. Since June 1, 2017, the final cars have been 35,193 and the decrees, 23,313.
