the legislative process

Precisely with the intention of avoiding tragedies such as the one that occurred in the capital, the so-called baby-saving law was introduced on 1 October 2018 n° 117 which modifies article 172 of the Highway Code and which was to enter into force in July 2019. postponed due to the lack of an implementing decree. Approved the decree No. 122/2019 (or “seat decree”) which specifies the technical requirements of anti-abandonment devices, the law became effective on November 7, 2019.   • The anti-abandonment device must signal the abandonment of a child under the age of 4 on the vehicle on which he is being transported by the driver of the vehicle by activating one of the signals referred to in letter d);
  • b) the device must be capable of being activated automatically each time it is used, without further action by the driver;
  • c) the device must give a confirmation signal to the driver when it is activated;
  • d) in the event that the device detects the need to give an alarm signal, the latter must be able to attract the attention of the driver promptly through specific visual and acoustic or visual and haptic signals (for example what makes the a device when one of the function buttons is pressed), audible inside or outside the vehicle;
  • e) the anti-abandonment device must be able to activate the communication system indicated in letter g);
  • f) if powered by battery, the device must be able to warn the driver of low levels of remaining charge;
  • g) anti-abandonment devices can be equipped with an automatic communication system for sending messages or calls via wireless mobile communication networks.

Are there any doubts about the interpretation of the rule?

Yes. For example, they concern devices that require active intervention by the driver such as activating Bluetooth on your mobile phone to receive any alarms. Another doubt concerns the accessory devices placed on the seat which inevitably increase the child’s height and therefore could potentially alter the safety characteristics of the child seats approved on the basis of the child’s height.

Yes. Those who do not comply with the obligation to use risk a fine ranging from 81 to 326 euros. In the event of a recurrence within two years, the suspension of the license from 15 to 60 days is also envisaged.
