The group “Nirvana” was sued for sexual exploitation by the baby on the cover of their cult album.

Spencer Eldon, a 30-year-old baby on the cover, claims his parents never signed a statement allowing his photo to be used as a cover for the album.


The image is perceived as a symbol of capitalism. Variety magazine notes that nude, non-sexual images of children are not considered child pornography by law.

In addition, Eldon’s lawyer is of the opinion that the baby was presented as offering sexual services, because in the photo his private parts are not covered and a $ 1 banknote is floating in front of him.

However, Eldon’s lawyer gave a different interpretation, arguing that the inclusion of the banknote in the image made the child look “like a sex worker.”

Spencer says he has suffered from emotional stress all his life due to the popularity of the photo. Eldon filed lawsuits against living members of the group, Dave Grohl and Krist Novoselic, and the property manager of Kurt Cobain, his widow Courtney Love. Each of the defendants is seeking compensation in the amount of $ 150,000.

Eldon said he never received payment for the photo, other than the $ 200 his parents received for it on the day of the photo shoot.

So far, there has been no official response from representatives of Nirvana.
