The Arrest and Accusations Against Lawyer Yehudi Moszkowicz: A Misinterpreted Conversation

Lawyer Yehudi Moszkowicz has been overheard in conversations with his client Flor B. He told the Amsterdam newspaper Het Parool. Today it was announced that Moszkowicz is accused in Belgium of membership of a criminal organization, but according to the lawyer, wiretapped conversations in prison between him and his client have been misinterpreted.

Today the Flemish newspaper De Standaard announced that Moszkowicz was arrested in Beveren prison at the end of last month when he visited his client B. After interrogation, he was released on the condition that he no longer has contact with B. and his entourage.

The lawyer says he and his client had “the very serious suspicion” that they were being tapped. So they discussed a plan to find out if that was really the case. “We saw that as a project. We discussed several times the name we gave to that project. It was hardly about its content and how we wanted to demonstrate that eavesdropping,” Moszkowicz says. Het Parool.

‘I gave it my own interpretation’

The fact that the investigating judge quickly released Moszkowicz gives him hope that the case will end smoothly. “After I explained in very broad terms what that project of ours entailed, she seemed to think something like: ‘Oooh, that’s it?’ The seriousness of the matter disappeared from the room,” he said.

According to the lawyer who has an office in Utrecht, it happens more often that lawyers are accused of membership of a criminal organization. “In practice, the Belgian Public Prosecution Service uses this tool instrumentally to paralyze the defense of leading suspects. That is of course a very effective way of combating crime. But this action is a disastrous infringement of the right to a fair trial of suspect Flor B. and a very serious infringement on my position as his lawyer.”

It is not clear what role Moszkowicz would fulfill within B.’s criminal organization. “I don’t know that myself. I have virtually no file and therefore I don’t know what I should defend myself against. But people heard us talk about a project and must have started to give substance to it themselves.”

Unclear how the case will proceed

Moszkowicz’s Belgian lawyer calls his arrest last month “highly violent”, “completely unnecessary” and “disproportionate” in a written response. The Belgian Public Prosecution Service does not want to say anything about the further investigation. Whether the suspicion against Moszkowicz ultimately holds up remains to be seen.

Yehudi Moszkowicz is the grandson of Max Moszkowicz and a cousin of Bram Moszkowicz.
