The anti-reconciliation bracelet, which is intended to keep violent spouses and ex-spouses away, will come into force on Friday, according to a decree published in the Official Journal on Thursday.
This device claimed for years, which was one of the promises of the Grenelle to fight against feminicides, makes it possible to geolocate violent spouses or ex-spouses and to trigger an alert system when the latter approach their victim.
It will be accessible in five first jurisdictions (Angoulême, Bobigny, Douai, Pontoise and Aix-en-Provence) before being generalized to the whole of the territory on December 31, according to the Ministry of Justice. The Keeper of the Seals Eric Dupond-Moretti must go to the Pontoise court on Thursday for the deployment of this bracelet.
Around 1,000 bracelets are already available, according to the Chancellery. But they should only be issued very gradually, on a case-by-case basis for domestic violence cases.
The bracelet can be administered by decision of a judge, both in the context of criminal proceedings, to accompany a judicial review, and as a conviction. But also – and this is the novelty – in civil proceedings, by a family court judge, as part of a protection order for a woman who denounces violence and who is considered in danger.
In this case, it will then be necessary to ask the spouse for agreement before fitting the bracelet. If he refuses, the judge will be able to refer the matter to the prosecution to open a criminal investigation.
The victim on her side will receive a box that she must always have on her. Transmitter and receiver will then be geolocated and the perpetrator of violence will have to respect an “alert distance” defined by the judge.
