From 10 p.m. to 6 a.m., any professional activity carried out in Luxembourg must benefit from a higher hourly rate. But by how much? What is the maximum duration of these night jobs? What are the possible exceptions?
It would be simplistic to think that night hours only concern positions in factory. Thus, in Luxembourg, certain employees in the transport sector finance, for example, must also adapt their working hours to international activity. Not to mention the staff of stations-service, of the hospitalsof the transports in common, etc. Fact, almost 10% of employees in office would perform all or part of their contract between 10 p.m. and 6 a.m.the legal hours of “night work” in the Grand Duchy.
Any employee who will be on duty is considered a night worker. at least 3 hours during this nocturnal period.
Furthermore, for some posted jobs (and therefore starting their service at varying hours over the weeks), it is generally necessary to refer to the company’s collective agreement. This generally provides for various arrangements (salaries, rest) in the event that the share of night work is significant. for more than a quarter of the hours to be worked during the year.
2/ 📈What increase can you expect?💶
Étrangement, the Luxembourg law n.a no minimum bonus established. However, it is established that these hours are paid at least 15% more than “ordinary” working time. On the other hand, the legislation provides that this increase (recognition of the arduousness of these atypical hours) is not not subject to tax.
For staff working in the restoration (in the dining room as in the kitchen), the profession has estimated that a other bonus should apply if the mission entrusted involved being active between 1 a.m. and 6 a.m.. 3/ 👷♀️Equality between women and men?🧑🔬
The rule is for everyone the same. This parity only knows two exceptions : THE pregnant women and the breastfeeding moms. In the latter cases, until child’s 1st birthday, an employee cannot therefore be required to be on duty between 10 p.m. and 6 a.m. The exemption from night work will be The exemption from night work must in such a case be requested by the employee from her employer, who will forward this request to the occupational doctor for advice.
For an expectant mother, this same rule applies. It will be up to the occupational physician, consulted by the employee, to estimate from what point in the pregnancy any night work could actually harm safety and/or health of the mother or baby.
4/ 🚫Are there any limits?⏰
8 hours on average per 24 hour period : this is the normal working time of night workers, this over a period of 7 days.
On the other hand, for jobs involving tensions physiques, pressures mental or some particular risksit is prohibited to exceed 8 hours of night work per 24-hour sequence.
A special status also covers adolescents (apprentices in particular). Thus, in Luxembourg, minors can only work up to 10 p.m. at the latest and only in businesses operating continuously. A formal ban is placed on work between midnight and 4 a.m. Under 18s cannot be occupied over a period of 12 consecutive hours including the 8 p.m.-6 a.m. time slot.
