The defense submitted a motion to transfer jurisdiction from Graz to Vienna. The file was transferred from the Graz Higher Regional Court to the Supreme Court (OGH) before Christmas. It is not clear where the file lay and how long it took to process it. The fact is, however, that the Regional Court of Vienna, to which jurisdiction ultimately fell, was apparently no longer able to schedule a timely hearing. OGH-Sprecherin Alexandra Michel-Kwapinski on Wednesday rejected allegations that the decision had to be taken too long. The Supreme Court received the file on February 15, sent it to the General Procuratorate two days later for a statement, received it back together with the file on March 2, and clarified responsibility on March 25.

“There was no delay,” emphasized Michel-Kwapinski. The Vienna Regional Court for Criminal Matters is therefore responsible for the main hearing “because some of the executive acts covered by the indictment are said to have taken place in the district of the Higher Regional Court Vienna”. It is unclear when the main hearing will take place in Vienna. The Vienna State Office for the Protection of the Constitution and the Fight against Terrorism (LVT) had been informed before Tulpal I was released, “in order to take all necessary measures”.

Reactions

Justice Minister Alma Zadic (Greens) were extremely cautious about the matter in the press foyer after the Council of Ministers. The procedure within the jurisdiction will be checked internally. She wanted that do not anticipate.
