16-year-old Nikolai Kharkivsky, suspected of having committed a fatal accident on Gagarin Avenue in Kharkiv, refused to take a blood test. It is necessary in order to determine the possible content of foreign substances in the lymph.
The results of the analyzes can affect the definition of the criminal article and, as a result, the punishment. As noted by Igor Chernyak, the lawyer of the victims, despite the court’s decision on the compulsory analysis, Kharkivsky refused to hand it over, reports “Ukrinform“.
The representative of the injured party stressed: such a step of the person involved in the fatal accident confirms his refusal to cooperate with the investigation in this case. Chernyak stressed that this is also a “refusal of repentance.”
“The fact can be regarded as deliberate non-execution of the court’s decision,” the lawyer said, adding that in our state there is no mechanism that would allow compulsory blood tests, even despite the existence of a court decision.

At the same time, Dmitry Chubenko, the speaker of the Kharkiv Regional Prosecutor’s Office, said in a commentary to the publication that urine samples previously taken from a 16-year-old teenager showed that he was not intoxicated with alcohol or drugs.
As a reminder: on November 5, the Kievsky District Court of Kharkiv ordered Nikolai Kharkivsky to donate blood for analysis… The lawyer representing the interests of the family of the deceased man, Masi Nayem, explained that this is necessary for comparison, along with other special examinations that have already been appointed at the request of the prosecution.
According to him, the blood may contain residues of other substances, which may change the qualification of the article.
