TEEG invalidates election of the PAN state leader in Guanajuato

Guanajuato, Gto. The State Electoral Court of Guanajuato (TEEG) invalidated the call for the election of the State Steering Committee of the National Action Party (PAN), where local deputy Aldo Márquez Becerra was elected president; and as secretary, Juana de la Cruz Martínez Andrade.

The trial for the protection of the political-electoral rights of citizens TEEG-JPDC-124/2024, against the resolution issued by the Justice Commission within the trial CJ/JIN/114/2024, relating to the call and guidelines to lead Its State Steering Committee was initiated by the president of Congress, Fortino Alcantar Rojas.

“The project proposes to revoke the subject matter of the challenge and, assuming full jurisdiction, determine the loss of effects of the call and the guidelines for the election of the Guanajuato State Committee of the National Action Party,” read the coordinating secretary of the Second Presentation, Cynthia Patricia Campos Lajovich, in the TEEG plenary session.

He explained that the grievance regarding the fact that the call lacked criteria to comply with gender parity is well-founded and that it was not responded to by the PAN Justice Commission.

“Given the lack of provisions regarding gender parity and alternation, in the contested call, the project proposes its revocation for the issuance of a new one, in which such inconsistencies are resolved, giving greater benefit to the female gender. so that he can head the State Steering Committee,” states the draft resolution read by Campos Lajovich.

The magistrate, Alejandro Javier Martínez Mejía, stated that the topic addressed was of special interest, because it affects the state leadership of a political party.

The project under discussion warns of the lack of motivation of the PAN Justice Commission, as it failed to make a comprehensive statement regarding the disagreements of its members, he said.

“The call did not contemplate affirmative gender actions, which was not corrected in the agreement issued by the National Executive Committee of the PAN. It did not privilege Guanajuato to guarantee that the leadership of the State Steering Committee was assumed by a woman, which it did do in other states,” he noted.

The president of the TEEG, María Dolores López Loza, considered that it is not in accordance with the law for the Court to assume jurisdiction to hear the proposals made in the first instance and to order the issuance of a summons.

He explained that in other leadership elections, where the lack of gender parity was claimed, the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation ruled in favor of intra-party bodies being the ones to resolve the disagreements.

“It is disproportionate for this jurisdictional body to carry out a study that is not justified at this time to invade the internal life of the political party,” he pointed out.

The judge considered that what should be ordered is for the Justice Commission to resolve all grievances within a short period of time.

In this case, the constitutional principle of parity prevails, which obliges political parties to nominate women for state leadership, said Judge Yari Zapata López.

“In the state of Guanajuato there has never been a leadership headed by a woman. I will support the terms of my project,” she stressed. With two votes in favor and one against, it was approved to invalidate the call for the election of the state leadership of the PAN.

On September 23, the National Executive Committee of the PAN ratified the election of Aldo Márquez and Juana de la Cruz Martínez as president and secretary of the Guanajuato State Committee.

On September 2, in an extraordinary session, the State Council of the PAN approved that Aldo and Juana lead the new administration of the Committee for the period 2024-2027.

The former senator, Alejandra Reynoso Sánchez, was the first PAN member to demand a call where all PAN members could elect their leaders and not just the State Council.

On August 14, the PAN member had expressed her intention to run as state president of the PAN.
