The end of the conflict between Rafako and Tauron Wytwarzanie. The companies have been arguing for months over problems in the operation of the 910 MW unit in Jaworzno, whose general contractor was Rafako. Today it was reported that both companies reached an agreement under mediation.
By February 28, Rafako and Tauron Wytwarzanie will determine the final terms of the settlement, which they intend to sign by March 8, 2023.
In January this year, Tauron Wytwarzanie called Rafako to pay over PLN 1.3 billion as contractual penalties and compensation for faults and defects in the unit. In response, Rafako announced that it would file for bankruptcy and called on the company for payment of PLN 606.5 million, and Tauron Polska Energia for payment of PLN 251.1 million. Both companies consider the claims of the other party to be groundless.

. These works should allow the 910 MW unit to reach the guarantee parameters no later than by the end of 2023. The repair of faults and defects is important for improving the efficiency and economics of the unit’s operation in the long term – explains Trajan Szuladziński, President of the Management Board of Tauron Wytwarzanie.
End of mutual claims
In a Tuesday announcement, Rafako announced that the parties would refrain from pursuing mutual claims until March 8.
“We want to continue mediation before the Arbitration Court to conclude a settlement with respect for the interests of both parties,” said Radosław Domagalski-Łabędzki, President of Rafako. The head of the company emphasized in the release that, according to the contractor, the block has no design defects, and the defects that occurred at the beginning of its operation can be quickly removed. –
We were and are ready to adapt this unit to burn fuel that is available in the current situation, but it still has to be within the parameters for a high-capacity supercritical unit
– added President Rafako.
The concluded agreement will allow the unit’s contractual parameters to be verified, which is a key condition for minimizing financial claims.
In accordance with the arrangements with Rafako, we intend to do it using a certified external company, said the president of Tauron Wytwarzanie.
