The woman also argued in court that it was an accident and “I was not at fault.” The verdict was announced recently.
This case occurred at 11:14 a.m. on April 11, 2023. When the woman took the escalator upstairs at Beijie Nangang Exhibition Hall Station, she failed to abide by the principle of “hold the handrails tightly and stand firm on the steps” and stepped aside. He was not paying attention and his center of gravity was unstable. He fell backward and collided with two women behind him. One of them suffered a hip contusion and a right knee contusion, and the other suffered a left ankle contusion, a left foot contusion, and a left ankle contusion. There were abrasions and abrasions on the left foot. The woman was also charged with negligent injury by the Shilin District Prosecutor’s Office.
The woman complained in court, saying that she held on to the handrail of the escalator because the stairs were vibrating, and the handrail moved at a different speed than the stairs. The handrail of the escalator rose more slowly, while the stairs rose faster. She could not hold on. When she was helped up by others, a passerby told her that the people behind her had also fallen. “I looked at it at first and saw that a girl with short sleeves had an ankle injury. I said sorry to her, and then we moved. When I went to the MRT information desk, there was an injured girl. I thought it was an accident and I was not at fault.”
However, the judge inspected the monitor footage in the MRT station and found that after the woman stood on the escalator, she leaned her right forearm and body on the handrail, and supported her right cheek and chin with her right hand. After dragging his right hind leg backward, his center of gravity became unstable and he fell, affecting the two women behind him.
The judge of the Shilin District Court believed that there was no obvious vibration or beating during the operation of the escalator. Other passers-by riding the escalator took the escalator smoothly, and there was no instability in the center of gravity. He determined that the woman was involved in the accident. Have fault. Considering that the woman has denied the crime and has not yet reconciled with the victim because there was no consensus on the amount of compensation, she was ultimately sentenced to 50 days of detention for negligent injury and was fined NT$50,000. She can appeal.
