When Germany released Huawei, the Stockholm Court of Appeal of Sweden ruled on the 16th to stop the implementation of the temporary ban on 5G spectrum auctions, and the Telecommunications Regulatory Authority (PTS) can resume the auction without excluding Huawei. However, since PTS has to contact various telecom companies, it will not be held within this month. The specific date has not been finalized, and Huawei can still appeal during this period.
Huawei’s statement stated that PTS did not follow due process and did not consult Huawei as a relevant party before deciding on additional conditions for 5G spectrum.
Reuters quoted the Court of Appeal as saying that the uncertainty of the outcome of the case means that Huawei’s final judgment in prosecuting the PTS case may cause the bureau to revoke or reassess the additional conditions for 5G spectrum. The hospital urged that in order to protect the interests of all parties in the Swedish ICT industry, spectrum auctions can only be conducted when PTS has fully communicated with all relevant parties and reached an agreement.
Sweden was originally scheduled to hold a 5G spectrum auction last month. PTS announced additional conditions for operators to participate in the auction, excluding telecommunications companies that use Huawei and ZTE equipment, and requiring existing equipment to be removed by 2025. Huawei filed a lawsuit with the Stockholm Administrative Court of Sweden, which issued a temporary injunction one day before the auction.
