The suspect has been teaching the girl once a week since the summer of 2019. She was 16 years old at the time. In October of that year she reported fornication. She said she had kissed her teacher, that she had been touched and that they had oral sex. The suspect acknowledged that the two had a lot of contact with each other, but denied the sexual acts.
Credible statement
However, the court considers the girl’s statement credible, partly because it is supported by a statement from a friend. Conversations via Snapchat have also been read with “a clear cross-border and sometimes even explicitly sexual character”, the court said.
The man is “heavily blamed for not keeping a professional distance as a teacher in his dealings with the girl.” On the other hand, the court takes into account that the initiative for contact also seemed to lie with the girl and that ‘challenging questions’ were asked by her and classmates to the suspect in class.
It is also taken into account that the suspect lost his job as a teacher. He is now a catering employee. Unconditional imprisonment, as the prosecutor demanded, would have meant that he would lose this job. However, the maximum community service order has been imposed.
