At Henny and Pieter it is now so high that they have decided to put their house up for sale after 27 years of living pleasure. And all because of a fence that, according to them, has moved 50 centimeters. “I get stuffy when I sit here. It’s a horror that fence,” says Henny. “The problem is her [buurvrouw Anja red.] gets greedy and just takes a piece of land from you (…) When I see that head of hers I already feel sick. She’s just mean, intensely mean.”
Neighborhood girl Anja is not aware of any harm. According to her, the fence is in exactly the same place as the previous one, and it had been there for 30 years. So as far as she is concerned, the whining should be over. “It feels a bit like: we are going to bully Anja”, she says her side of the story. And those neighbors, they just use a piece of her land. And now that Anja is busy, she also wants to get rid of the neighbour’s tree, because it bothers her. And then there is also the gate, which her neighbors use to then walk on her property. According to Anja, Pieter and Henny have no right of way, something they contradict themselves.
When Meester Visser and Viktor arrive on site to investigate the matter, they make a startling discovery: the property boundary runs right through Henny and Pieter’s elderberry tree. But it doesn’t stop there. Viktor soon discovers that the property boundary also runs right through Pieter and Henny’s barn.
During the hearing it soon becomes clear that everyone prefers to see that the correct boundary is maintained. And that means that a new fence must be built, paid for by both neighbors. Henny and Pieter’s shed, which is thirteen centimeters over the property boundary, may remain because it is time-barred by the judge. With regard to the right of way, Meester Visser is clear: Henny and Pieter are not allowed on Anja’s ground, so the gate will have to be closed. Finally, the tree will also have to be removed and paid for by them together. If they do not comply, the fines can be up to 20,000 euros.
