Surabaya District Court Sentences Stella Monica Free from the ITE Law

Defendant Stella Monica acquitted in connection with a violation of the Electronic Information and Transaction Law (ITE) because of his complaint as a consumer from a beauty clinic in Surabaya, East Java.

Judge Imam Supriyadi, who read out the verdict, stated that Stella was not proven guilty of committing a criminal act of defamation of the L’Viors beauty clinic in Surabaya.

“The trial, stated that the defendant, Sister Stella Monica, was not proven legally and convincingly guilty of committing the criminal act that she was accused of,” said Judge Imam when reading the verdict at the Surabaya City District Court, Tuesday (14/12).

Imam continued that after Stella was acquitted, the panel of judges asked the Public Prosecutor (JPU) to restore Stella’s good name.

“Therefore freeing the defendant from all charges by the Public Prosecutor and restoring the defendant’s rights in terms of ability, position, and dignity and worth,” he said.

Responding to this, the public prosecutor also admitted that he would think about taking the next legal step. They have up to 14 days ahead.

“Think about who started,” said the prosecutor.

After the trial with the reading of the verdict, Stella also expressed her gratitude to all parties who supported her as a consumer who was criminalized using the ITE Law.

For information, this case went to court after Stella was reported to the police using the ITE Law regarding her vent on her personal Instagram account about her facial health condition after undergoing treatment at the L’Viors beauty clinic. The clinic reported it to the police on suspicion of defamation of the ITE Law.

During the trial, the prosecutor judged Stella to have violated Article 27 paragraph 3 Jo Article 45 paragraph 3 of the ITE Law and sued her with the threat of 1 year imprisonment and a fine of Rp10 million subsider 2 months imprisonment.

During the legal process, Stella received support from various parties, both online and through demonstrations. The reason, he is considered only to convey criticism and use consumer rights.
