Supreme Court Suspends Controversial Law Pushed by Netanyahu’s Government

The judges voted by just one vote to suspend the law pushed by Prime Minister Benjamin Netanyahu’s government. The statement notes that once it enters into force, it could cause serious damage to Israel’s fundamental principles as a democratic state.

The most controversial point in it was the ban on judges overturning, in their opinion, unreasonable government decisions, and after this decision, the debate on the issue continues.

The representatives of the government repeatedly emphasized that in this way the judges have taken into their hands all the powers that are evenly distributed between the three branches of power in a democratic regime. Critics of the initiative, on the other hand, point out that these judicial powers are the most important element in maintaining balance and preventing Israel’s liberal democracy from turning into an autocracy.

The law has previously caused widespread protests by citizens, and experts allow the possibility that the Supreme Court’s decision could encourage them again.

CONTEXT:

Israel has seen several mass protests in 2023 since Prime Minister Benjamin Netanyahu’s government announced plans to reform the country’s judicial system in January last year.

The Israeli government has insisted that the Supreme Court interferes too much in political decisions and is pushing for legislation to allow parliament to overturn court decisions with a simple majority vote. The reform would also give the government more power over the appointment of judges, increasing the government’s influence over the commission that selects judges.

Critics have pointed out that the reform threatens the separation of powers.
