New Delhi: The Supreme Court has made an important observation that the Governor has no power to change the Minister without the recommendation of the Chief Minister. The court said that if the ministers are to be removed from the cabinet, the recommendation of the chief minister is necessary and the governor cannot remove them without their recommendation. The court’s reference is in a case related to Tamil Nadu minister Senthil Balaji.
The court rejected the plea seeking the removal of Senthil Balaji from the post of minister. Currently, Senthil Balaji is a minister without department. The Supreme Court was approached after the High Court rejected the plea to remove the Minister who was arrested by the Enforcement Directorate (ED) in the case of taking bribe for government job. The court also said that there is nothing wrong with Senthil Balaji continuing as minister without department.
