Supreme Court Orders Transparent Documentation of Covid-19 Vaccine Authorization Process

The Supreme Court of Justice of the Nation (SCJN) ordered the Federal Commission for the Protection against Sanitary Risks (Cofepris) to make transparent all the documentation related to the authorization process of the vaccine against Covid-19 “CoronaVac”, manufactured by the Sinovac company.

It is the first time that the highest court confirms a resolution of the National Institute for Transparency, Access to Information and Protection of Personal Data (Inai) related to the publication of official documents on the authorization and purchase of vaccines to face the pandemic.

Unanimously, the first chamber of the highest court ruled in favor of ratifying the resolution of the Inai plenary regarding the administrative review appeal 6564/21, which ordered Cofepris to deliver a public version of the document requested by a citizen.

In its session on June 23, 2021, the INAI plenary session indicated that this report must explain how “it was determined that the vaccine could be applied to the population, so that by its very nature it does not imply a danger to a person or specific group of people.

According to data from the Ministry of Foreign Affairs (SRE), the Sinovac vaccine is one of the seven most applied in our country, with a total of 20 million doses, until May of last year.

The Inai pointed out that Cofepris must deliver the information that was requested since “it did not specify if in the specific case there was any international negotiation or if it referred to the international relations of the Mexican State; nor did it provide any element that would allow us to infer the aspect that it tried to assert as an assumption of protection of information”.

The CJEF appealed the Inai’s decision by presenting before the SCJN the appeal for review in matters of national security 10/2021, however, the first court approved the project of Minister Mario Pardo Rebolledo where it was decided that “the appeal for review is discarded and The appealed resolution is final.”

Before this ruling, the SCJN had sided with the CJEF and the Ministry of Health in the appeals against Inai resolutions that asked for transparent information about vaccines against Covid-19.

Even in the same session where this matter was approved, the ministers resolved to endorse the reserve of information on three other petitions that asked to reveal the contracts for the purchase of other vaccines.
