“Supreme Court dismisses PIL challenging PM Modi’s inauguration of new Parliament Building”

New Delhi: The Supreme Court has dismissed a PIL challenging the inauguration of the new Parliament building by Prime Minister Narendra Modi. Advocate Justice C.R. asked the Lok Sabha Secretariat to instruct the Parliament building to be inaugurated by President Draupadi Murmu. The Supreme Court clarified that the petition submitted by Jayasukin cannot be considered.

Justices J.K. Maheshwari, P.S. The petition was heard by the vacation bench of Narasimha. The court pointed out that under Article 32, it has no jurisdiction to interfere in such petitions. The court did not accept the petitioner’s contention that according to the Constitution, the inauguration should be done by the President.

The petitioner sought permission to withdraw the petition but the court did not allow it. If the petition is allowed to be withdrawn, it was refused on the ground that the High Court could be approached. The petitioner’s contention was that the Lok Sabha Secretariat’s action of not inviting the President to the inauguration of the new Parliament building was unconstitutional.

According to Article 79 of the Constitution, the President is the first citizen of the country. He has the power to summon and adjourn sessions of Parliament. The Prime Minister and other ministers are appointed by the President. All executive actions are in the name of the President. It has been argued that not inviting the President to the function is humiliating and unconstitutional. In this regard, it was pointed out in the petition that the statement issued by the Lok Sabha Secretariat was unilateral and not correct.
