He Supreme Court has dismissed the complaint filed by Judge Manuel Piñar, head of the Criminal Court 1 of Granada, who sentenced in the first instance Juana Rivas, for the inadmissibility of the cassation appeal before the filing of her complaint for insults and slander against Juana Rivas’s lawyer.
Judge Piñar had filed a complaint against the lawyer Carlos Aranguez for alleged insults and slander for statements in which he accused him of being “manifestly biased” in the case of Juana Rivas, whom he convicted of child abduction.
The Investigative Court 5 of Granada filed the judge’s complaint in November 2022, dictating the free dismissal of the proceedings considering that the facts “do not constitute any crime.”
The lawyer had made these statements before various media outlets, as well as in the exchange of messages in a WhatsApp group that he shares with more than a hundred journalists to report on the evolution of judicial cases.
Judge Piñar appealed the file and the Provincial Court supported the dismissal. The judge’s appeal to the Supreme Court and its dismissal closes the procedure definitively.
Piñar denounced, among other things, that Juana Rivas’s lawyer acted with “malicious imagination” to try to discredit him when he publicly criticized that the sentence in Juana Rivas’s case had been handed down “in seven hours” given that it was dated the same day in that the trial was held.
