Supervisory Board of VfB Stuttgart: Board members have to go – football

As the supervisory board of VfB Stuttgart 1893 AG announced, it decided in an extraordinary meeting on Saturday to dismiss the board of directors for marketing and sales and the board of finance with immediate effect.

The decision therefore followed a unanimous decision. On the one hand, it is about Jochen Röttgermann, who has been Head of Marketing and Sales since 2015. Stefan Heim, who has been responsible for finance, administration and operations since 2015, is also affected. The names of the two officials were not mentioned in the communication. The Supervisory Board will discuss the successor “at short notice”.

Backing for Hitzlsperger

At the same time, the Supervisory Board has given Thomas Hitzlsperger support. “Unreserved trust” was given to the CEO. The clarification of the data protection affair was “legally compliant”. This emerges from investigation reports and legal opinions that are available to the Supervisory Board. The announcement also states: “The CEO of VfB Stuttgart 1893 AG will bring about further personnel decisions as soon as possible, taking into account the special labor law conditions for employees.” That means that further personnel consequences will probably be drawn soon.

Is there a risk of the spin-off being reversed?

For weeks it has been simmering behind the scenes at VfB Stuttgart. Fine proceedings had been opened against the club on suspicion of treason. On Friday, the Presidium decided against the will of President Claus Vogt that the general meeting should take place on March 28th. At the end of last year, Hitzlsperger had sharply criticized Vogt and announced a candidate to fight for the presidency. The ex-international later apologized for his choice of words and withdrew his candidacy.

The question arises as to whether the outsourcing of the professional department at VfB Stuttgart was legal? This was decided on June 1, 2017 at an extraordinary general meeting. SWR sports reporter Stefan Kiss spoke to the renowned specialist lawyer Marius Breucker (commercial and corporate law / banking and capital market law). What the expert from the Wüterich / Breucker law firm says gives cause for concern. At the same time, the Stuttgart lawyer’s assessment raises new, explosive questions.

The turbulence at Bundesliga soccer club VfB Stuttgart is endless. Now the decision to outsource the professional department could even shake.

The decision to outsource is “void” if there is a serious deficiency, says Breucker. “If it turns out in retrospect that the decision was void, then it should no longer be observed by the authorities.” Breucker goes on to say: “That would be affirmed, for example, in a case in which a candidate had access to membership data in the run-up to an election and his competitor did not, and therefore a violation of equal opportunities in the subsequent election was affirmed.”
