The National Superintendency of Higher University Education (Sunedu) sanctioned the Alas Peruanas University with a total fine of 9 million 353 thousand 318 soles for using its assets for non-university activities and for not meeting the information requirements made during the supervision.
According to article 21 of Law 30220, University Law, and in its Organization and Functions Regulation, Sunedu has the power to supervise and control the fulfillment, by universities, of the obligations established in the University Law and its related regulations, including the use of its assets for university purposes and the improvement of educational quality.
Thus, paragraph 1 of article 116 of the University Law specifies that the assets of the universities are used exclusively for university purposes. Failure to comply with this obligation is classified as a very serious infraction in the Regulation of Infractions and Sanctions of the Sunedu.
Along these lines, in 2019, Sunedu initiated a sanctioning administrative procedure in order to verify the correct use of assets by the UAP and, after concluding the sanctioning procedure, it was found that the university, during the year 2017, used part of its assets irregularly:
1. It used 22 properties, owned and leased, to carry out activities not linked to a university purpose.
2. It used assets for expenses in educational activities at the Alas Peruanas Institute in Lima and for the operation of the Los Angeles Club, which were not linked to a university purpose.
3. He used 83 vehicles for purposes other than university.
4. During 2017 it used assets for expenses in: vehicle rental; purchase of vehicles that were not used; as well as fuel, spare parts and fines, which were not linked to a university purpose.
5. He used assets for payment of medical and dental expenses of university government authorities, which were not linked to a university purpose.
6. For disbursements authorized by the former Rector, which were not linked to a university purpose.
7. Expenses for a dental laboratory service, which was not linked to a university purpose.
8. During 2017, he used S / 319 923.00 for non-deductible travel expenses, which were not linked to a university purpose.
9. The university used assets for repairable compensation and bonuses, which were not tied to a university purpose.
10. Assets were used to grant loans to related companies and third parties, which were not linked to a university purpose.
In addition to the sanction, Sunedu ordered the following corrective measures:
1. Identify the people who authorized and / or allowed the use of assets that are the subject of this procedure; determine their responsibility and, consequently, declare their vacancy – in the case of authorities elected by universal vote -, dismissal or dismissal from the position they exercise, according to what corresponds in accordance with the University Law or its internal regulations.
2. Present to Sunedu a protocol that includes rules that aim to minimize the risks of deviation in the use of assets for university purposes and the improvement of educational quality, as well as the negative repercussions on the university’s accounting.
3. Agree on interests regarding loans to related companies and third parties, or prepare a plan stating the actions to be taken, and the corresponding programming, to recover the amounts granted as a loan.
4. Prepare control documents for their own vehicles, which contain all the information that makes it possible to clearly determine the use provided.
The decision of the Sunedu Board of Directors has been notified to the UAP; However, the university is within the term to file a reconsideration appeal, which will be reviewed by the Board of Directors, reports Sunedu.
It also urges all private universities to comply with their obligations regarding the use of assets and benefits granted by the current legal framework in order to achieve the improvement of the educational service and not jeopardize the fulfillment of its objectives.
