Faced with the problem of illegal property trafficking, Sunarp has implemented the free service of Temporary Immobilization of Items in the Land Registry, through which the owner of a house, apartment or land can voluntarily place a “padlock” and temporary to the game where your property is registered, immobilizing it in order to prevent unscrupulous people from making transfers, charges or encumbrances on it.

But, in what cases is it recommended to immobilize a property? It is recommended to immobilize a property when for work, study or other reasons, the owner has to be absent from his city for a long time. It is also recommended to immobilize a property when you have two or more properties and only one of them is going to be occupied.

This does not prevent any person who does not intend to transfer their property from also requesting the temporary immobilization of their property.

Sunarp details the ways to request the immobilization of the registration of the item in the event of possible registration fraud, in Resolution No. 057-2023-SUNARP/SN, published today in the newspaper El Peruano.

How to carry out the procedure?

There are two modalities: item immobilization with electronic notice, which is totally free, and item immobilization with registry entry. To request temporary immobilization, the owner of the property must go to any Sunarp office or any notary and make the request effective. In the event that the owner of the property is a conjugal partnership, both must be involved.

Immobilization of game with electronic notice.

It is requested in person using the Sunarp format. Your registration generates an electronic notice linked to the registration item. The procedure is as follows:

• Title registration request (free distribution form available at the following link https://www.gob.pe/institucion/sunarp/informes-publicaciones/3997685-formatos-de-inmovilizacion-de-partidas), duly filled out and signed by the presenter (person who carries out the procedure at Sunarp).
• The application form for the electronic notation of immobilization of items, which can be downloaded from the Sunarp institutional website (www.gob.pe/sunarp), duly filled out and signed. Said format contains, among others, the affidavit of the registered owner, in the sense that the property on which the immobilization is requested has not been transferred or is with a voluntary charge or lien, not registered, of a certain date prior to the presentation of the immobilization request.
• Registration fee payment: Free.
• Qualification period: 7 business days from the following day.

Immobilization of game with registration entry.

It is requested by means of a notarial part of a public deed and an affidavit with a notarial certified signature whose registration is made in the registry entry of item F) Others and its lifting is carried out with a notarial part of a public deed that is registered in item E) Cancellations of the item property registry. The procedure is as follows:

• The application for presentation of title.
• Notarial part of the public deed of immobilization granted by the registered owner or his representative.
• Sworn statement, with signature certified by a notary, of the registered owner or his representative inserted or attached to the notarial part, in the sense that the property on which the immobilization is requested has not been transferred or is with a voluntary charge or encumbrance, not registered , of a certain date prior to the presentation of the application for the immobilization of the game with a registry entry.

The immobilization of the item with a registry entry is not subject to the payment of registry rights.

How long can a game be frozen?

The temporary immobilization will have a maximum validity of 10 years, counted from the day of its presentation in the Real Property Registry. A shorter term may also be requested. The immobilization will expire by operation of law within the established period.
