Subjective article, the suspect runs away

SERANG, KOMPAS.com – Serang District Attorney’s Office Refuses to Suspend Detention of Suspect in Defamation Case Nikita Mirzani.

With this decision, Nikita Mirzani remains in detention at the Serang Classe IIB Rutan until November 13, 2022.

The head of the Serang District Attorney’s Office, Freddy D Simandjuntak, said Nikita’s proposed suspension of detention refusal through her attorney complies with the prosecutor’s monitoring and analysis.

“From the investigation phase to phase II, this has also become one of the reasons why the prosecutor did not grant a suspension of detention,” said Freddy when he was contacted by Kompas.com via a WahtsApp message. Saturday (29/10/2022).

Another consideration, Freddy said, is because it is under Article 21 paragraph 1 of the Criminal Code that the suspect is feared to escape.

“Another reason is according to the subjective article, to run away or repeat his actions,” said Freddy.

Previously, Nikita Mirzani’s attorney had filed a stay of detention with the Serang District Attorney, Banten on Wednesday (10/26/2022) or the day after Nikita’s arrest.

Nikita’s lawyer Fahmi Bachmid said it is the right of those seeking justice to ask for a suspension of detention.

The reason for requesting a suspension of detention is because Nikita has not been detained since the investigation process at the Serang City Police and only needs to show up once a week.
