Studio 100 challenges the granting of radio license to competitor Nostalgia

Studio 100 is trying to get back into the race to get a radio license after all. According to the entertainment company, competitor Nostalgie does not meet the recognition requirements for a national frequency. That writes The time Saturday.

In a registered letter that Studio 100 sent to Flemish Minister of Media Benjamin Dalle (CD&V) this week, the company around the entrepreneurs Hans Bourlon and Gert Verhulst asks for the withdrawal of the recognition of Nostalgie. According to Studio 100, the Mediahuis channel should never have been assessed, because the file conflicts with the recognition conditions of the Media Decree.

Specifically, Studio 100’s analysis focuses on Article 138. This sets the recognition condition that a national channel must “broadcast at least four newscasts a day, which are provided by its own editorial team, which mainly consists of recognized professional journalists”. According to Studio 100, what can be read in the jury’s report is not compatible with that condition.

Move in

The media company formally asks Dalle to revoke and assign Nostalgia to him within 60 days. In addition, Studio 100 subtly notes that it expects a quick answer, “because the deadlines for an appeal to the Council of State are running”.

Tom Demeyer, Dalle’s spokesman, says that the minister has obtained legal advice from both the law firm Stibbe and Deloitte Legal. “The legal advice is crystal clear: Nostalgia should be recognized. Anyone is free to disagree with that conclusion and act accordingly. That is what the Council of State exists for.”
