Strict Texas abortion law may remain from higher court

Under the new law, an abortion may no longer be performed if a heartbeat can be detected in the fetus. That can be as early as six weeks of pregnancy. There is also no exception for pregnancies through incest or rape.

Earlier this week, the judge ruled that the law restricts women’s freedom of choice and that this should not last ‘a day longer’. The implementation of the law has been suspended pending legal action.

To Supreme Court

A higher court ruled that the Texas judge should not have issued an injunction. The case may now go to the U.S. Supreme Court. That previously refused to take a case on the law in Texas.

The Texas Attorney General, a Republican, is pleased with the ruling. He tweeted that it is “great news” and that he will continue to fight against federal government interference in his state.

Citizens sue each other

In several states where Republicans have the majority in parliaments, attempts have been made in recent years to ban or make abortions more difficult.

Texas law circumvents an earlier Supreme Court ruling from 1973, which ruled that abortion is legal in the US. Under the anti-abortion law, citizens can sue each other for performing an abortion, which means that enforcement is not up to the state.
