“At first I was convinced that it was too improbable to be possible. And yet” – this is how Professor Włodzimierz Wróbel, a judge of the Criminal Chamber of the Supreme Court, commented on Donald Tusk’s move.
He published the decision of the Prime Minister, who agreed to Supreme Court judge Krzysztof Wesołowski becoming the commissioner to conduct the election of the President of the Civil Chamber. He is a neo-judge who was appointed to the Supreme Court under the act on the National Council of the Judiciary, authored by PiS.

“There is no desire to try to restore the rule of law”
— I really don’t like this decision of the prime minister. Or rather: it is unwise. Or it was some political bargain, I don’t even want to think about what kind. But then we are talking about pure politics, untempered by the rule of law. Or someone overlooked something, neglected to check who the president was appointing, which in itself is regrettable, says Prof. Ewa Łętowska, retired judge of the Constitutional Tribunal and the Supreme Administrative Court, former Commissioner for Human Rights, to Onet.

— This whole situation simply makes anyone reluctant to take any action related to restoring the rule of law. After all, it was an opportunity to sort out a bit of the Supreme Court’s affairs. And it was squandered. I will repeat, what happened is simply unwise. Because politically, although it is not my area of expertise, there was probably something to gain, too – sums up Prof. Łętowska.
What does Donald Tusk’s decision mean?

The Prime Minister’s decision, i.e. countersigning the President’s resolution to appoint a new judge as a “commissioner” for the selection of a new president of the Civil Chamber of the Supreme Court will result in only the neo-judges from the Civil Chamber being able to select candidates for the new president of their chamber from among the same neo-judges. This means that for the next three years, which is the term of office of the president of the Supreme Court chamber, an important room it will be headed by a person whose appointment is considered to be clearly defective by the European courtslike the legal judges of the Supreme Court themselves.
