Yesterday, soldiers of the Provincial Command of the Guardia di Finanza and the Forestry Carabinieri Group of Bari they executed a decree of urgent preventive seizure ordered by the Public Prosecutor’s Office at the Court of Trani, concerning the business complex owned by a company company operating in the municipal solid waste management sector. The seals are triggered on two distinct operational units located in Corato and concerned the properties where the activity is carried out, the company assets as well as the intangible assets intended for the management of the plant.
The precautionary measure arises from previous investigative activities carried out by Corato Forestry Carabinieri Unitthe outcome of which criminally relevant hypotheses emerged against the company’s legal representative. In particular:
during an access carried out in February last at one of the company’s operational offices, certain critical issues were detected in relation to the waste storage methods. The activity subsequently carried out also made it possible to detect multiple illegalities in the waste processing and classification processmainly made of paper and cardboard. In addition to this, a further check carried out by the Fire Brigade made it possible to detect multiple violations of the current legislation on fire prevention. The precautionary measure, whose execution was entrusted by the AG to the joint action of the Company of the Guardia di Finanza of Molfetta and the Carabinieri Forestry Unit of Corato, involves both the administrator, as a suspect for illicit disposal of waste, and the company he represents, to which violations regarding the administrative responsibility of entities as well as safety at work are contested, given the total absence of suitable measures to prevent environmental crimes as well as the risk of fires (assessment carried out in the preliminary investigation phase which requires the related procedural verification in the cross-examination with the party).
This operation constitutes further evidence of the constant protection of legality ensured by the Public Prosecutor’s Office of Trani making use of the Guardia di Finanza as economic-financial police and of the Forestry Division of the Carabinieri as environmental police, for the repression of tax crimes, corporate and bankruptcy as well as crimes in environmental matters, in this case with greater attention to the verification of the forms of illicit management of the waste cycle. It should be noted that the criminal proceedings are pending in the preliminary investigation phase and, therefore, the persons under investigation have not yet been sent to trial and cannot be considered guilty until a final conviction has been pronounced.
