STJ determines intervention in the CBF and leaves the entity’s political landscape undefined | soccer

A decision by the Superior Court of Justice (STJ) handed down this Thursday determined intervention in the entity and defined that the oldest director temporarily assumes the presidency of the CBF.

The decision is part of the process brought by the Public Ministry of Rio de Janeiro against the CBF, in which it asks for the annulment of the election of Rogério Caboclo, which took place in 2018, and asks for changes in the electoral rules of the entity. It was published at 2:18 pm, when the General Assembly had started that would vote on a new punishment against Caboclo – and that would result in his definitive removal from the entity.

As a consequence of the Assembly’s decision, the position of president must be filled by the oldest vice-president, who is Antonio Carlos Nunes, 83 years old. As he is on medical leave, the position passes to the second oldest, Antônio Aquino, 75 years old. He, however, gave up the presidency.

Thus, following the decreasing order of age of the vice-presidents, the presidency continues with Ednaldo Rodrigues, 68 years old, who has held the post temporarily since August 2021. Now it is Ednaldo who must call the election to decide who will complete Caboclo’s term, until April 2023. He must be the only candidate in this election, in which only vice presidents can run.

Regarding the decision of the STJ, in the corridors of the CBF, there is no consensus on the oldest director. It is unclear whether he will be considered Dino Gentile, wealth director, or Carlos Eugenio Lopes, legal vice president. However, the position of legal VP does not exist in the entity’s statute, which makes Carlos Eugênio Lopes considered legal director.

Lopes is older than Gentile, but the question of his position sows doubt in the entity. The wealth director was appointed by Marco Polo Del Nero, with whom he worked at the São Paulo Football Federation. Therefore, until the practical repercussions of the STJ’s decision are understood, Ednaldo Rodrigues will be the president of the CBF.

The Public Ministry contests the legality of the CBF election because of a general meeting – without the participation of the clubs – held in March 2017. At the time, the entity defined new rules for its elections. The entity’s electoral college was formed by the 26 state federations plus the Federal District, the 20 Serie A clubs and the 20 Serie B clubs of the Brazilian Championship.

In this assembly, which did not have a vote from the clubs, the CBF established that the votes of the state federations would have a weight of 3, the votes of the Serie A clubs would have a weight of 2 and the votes of the Serie B clubs would have a weight of 1. In practice, if the 27 federations to vote for the same candidate, they would have 81 votes. If the clubs joined together, they would have 60 votes.

According to prosecutor Rodrigo Terra, who called the CBF in 2017, the change “did not follow the democratic rules provided for by legislation”.

– Voting was illegal as it did not give opponents a chance to make a candidacy viable. In addition to maintaining the federations as a majority in the electoral college, the barrier clause makes any opposition candidacy unfeasible and favors the political group that has been in power there for decades. That’s why we want a new vote with equal chances – said Terra.

Last year, the 2nd Civil Court of Barra da Tijuca granted the MP’s request and appointed Rodolfo Landim and Reinaldo Carneiro Bastos as interveners. Landim even sat in the chair of the CBF president for a few minutes, but the decision was overturned by the CBF still in court in Rio.

Subsequently, on appeal from the MP, judges of the 19th Civil Chamber determined, again, the reappointment of the two leaders. The CBF then appealed to the STJ and managed to suspend the intervention once again.
