Steinmeier confirms new limit of 3.5 nanograms of THC while driving. This makes the change in the law official.
Federal President Frank-Walter Steinmeier (SPD) has now signed the law to change the THC limit. This was announced by the Presidential Office in Berlin. This is reported by the Ärzteblatt. The new limit is now 3.5 nanograms per liter of blood serum, instead of the unrealistic 1.0 nanogram. The limit of 1.0 nanogram had to be changed because it did not exist according to any scientific standards. This meant that it was possible (and did happen) for drivers who were not intoxicated to lose their license because ineffective THC was still present in the blood. THC can be detected in the blood for significantly longer than it has an effect. However, mixing it with alcohol is not permitted.
As soon as the law comes into force, the following will apply: “Anyone who intentionally or negligently drives with 3.5 nanograms of tetrahydrocannabinol (THC) or more generally risks a fine of 500 euros and a one-month driving ban.” In combination with alcohol, the fine is 1,000 euros. As with alcohol, there are no exceptions during the probationary period, where the limit is 0.0. Now the law just has to come into force for the change to officially apply. The limit is now set according to sensible standards.
