Returning to the dismissal of brisacco, US NLRB regional directors have issued dozens of complaints accusing Starbucks of breaking the law in their efforts to overthrow the unionincluding threats to workers and retaliation against activists.
The Bloomberg article adds that: The labor board has the authority to order companies to reinstate fired workers and refund wages, but generally cannot hold executives personally liable for alleged wrongdoing or issue punitive damages. This fall, agency judges ordered Starbucks to reinstate fired activists in Michigan and Kansas, and a federal judge in August ordered the reinstatement of seven union supporters at a Memphis, Tennessee store.

The pace of Starbucks’ unionization wins has slowed significantly since earlier this year, and none of the unionized stores have come close to reaching a collective bargaining agreement with the company. In an interview, Brisack said that retaliation against activists had “prevented countless stores from organizing” and that winning the reinstatement of those who were fired or kicked out of the company would reassure employees it was safe to get involved.
In this sense, Brisack said that only legal complaints they will not be enough change the behavior of the company.
